Bankruptcy FAQs
Will I lose my home? It depends. If you are current on your mortgage, you should be able to keep it. Chapter 13 enables you to place your mortgage arrears into your repayment plan so you can catch up on your payments and keep the home even if you are behind in payments.
Will I have to sell my car? Usually not. Chapter 7 and Chapter 13 allow you to exempt $5,000 of equity from automobiles. Under Chapter 13, you may place your payments into your reorganization plan to catch up on car payments.
Do I have to sell off my belongings? Not necessarily. You will not have to sell items that are exempt, however you may need to sell or surrender items that are not exempt.
I will not be able to get credit again, right? Wrong. A bankruptcy remains on your credit report for up to 10 years, however your credit score may improve shortly after filing.
Do I have to be unemployed to file for Chapter 7? No. Your income simply must fall within the parameters of the means test.
Can I file for bankruptcy on my own? Yes, however, I strongly recommend that you consult a qualified lawyer. As a volunteer with the self-help center of the bankruptcy court, I understand the serious mistakes and penalties associated with incomplete or inaccurate petitions.
