Glendale Bankruptcy Attorney
Filing for bankruptcy may seem simple; however, without precise preparation and execution, you could suffer serious penalties. As a volunteer with the bankruptcy court's self-help center, I have helped individuals repair the damage they have caused by trying to file their petitions on their own.
At the Arizona The Law Offices of Anca Iacob, I provide comprehensive Chapter 7 and Chapter 13 bankruptcy representation. I take a proactive approach to preparing and filing petitions to ensure a successful discharge. With extensive federal Bankruptcy Code knowledge, I can review your financial information and determine if bankruptcy protection is right for you.
My law practice is dedicated to helping individuals find resolutions to their most serious financial matters. I truly care about my clients' financial outlook and treat everyone with dignity and respect, because I understand you are trusting me with your matter.
Thorough Pre-Filing Preparation
The key to a successful bankruptcy discharge is found in its pre-filing preparation. I take extra steps during this phase of your case to ensure you can achieve your goals. I care about my clients and am dedicated to protecting their rights and their futures.
My experience preparing and filing bankruptcy petitions enables me to prevent future court intervention. I devote necessary time, talent and resources to help ensure that your only legal obligation after filing your petition should be a meeting of creditors.
I also understand that the scope of financial information required to properly file your Chapter 7 or Chapter 13 petition can be overwhelming, however an incomplete or improperly drafted petition can lead to allegations of fraud from your creditors. I am committed to providing exceptional service.
The Bankruptcy Process
Bankruptcy is a person's legal right to file a petition in federal court that allows that person to seek to discharge all or most of their debt. The means test is used to determine which bankruptcy protection plan you may pursue.
When you can no longer manage your debts, you may be able to wipe them away through a Chapter 7 liquidation bankruptcy. Under Chapter 7, certain debts that are not secured with collateral, such as credit card debt, payday loans, personal loans and medical bills, can be discharged.
Those who do not qualify for Chapter 7 based on the means test, or those looking to avoid a foreclosure, may be eligible for a Chapter 13 debt reorganization plan that allows individuals to repay most or all of their debts within a three-to-five-year time period. This plan can help individuals facing foreclosure or repossession by placing the arrears or car payments within the plan, allowing individuals time to catch up on payments and maintain the property.
Bankruptcy guidelines can be complex. Refer to Bankruptcy FAQs for more information.
The Automatic Stay
Both Chapter 7 and Chapter 13 bankruptcy protection include an automatic stay on all legal action against the petitioner in the pursuit of collecting on a debt. That means filing for bankruptcy automatically prevents creditors from contacting you or filing a lawsuit against you, including:
- Wage garnishment
- Bank levies
- Repossessions
- Property tax sales
- Evictions
